Terms of Service

The terms that govern your use of bakerhouse.com and any HVAC or refrigeration service we provide.

These Terms of Service ("Terms") govern your access to and use of bakerhouse.com (the "Site") and any heating, ventilation, air-conditioning, or refrigeration ("HVAC/R") services provided by BakerHouse Service Co. ("BakerHouse", "we", "us"). By using the Site, requesting a quote, scheduling service, or accepting any work we perform, you agree to be bound by these Terms.

1. Who We Are

BakerHouse Service Co. is a licensed, bonded, and insured HVAC and refrigeration company operating in the State of New Mexico. Our principal address is 218 Wells Dr NE, Albuquerque, NM 87123. You can reach us at 505-KING-420 or bakerhouseserviceco@proton.me.

2. Use of the Site

You may use the Site only for lawful purposes. You agree not to:

  • Use the Site in a way that violates any applicable law or regulation;
  • Submit false, misleading, or fraudulent information when requesting service or a quote;
  • Attempt to gain unauthorized access to, interfere with, or disrupt the Site, our servers, or any related systems;
  • Use any automated means (bots, scrapers, crawlers) to access the Site without our prior written consent;
  • Reproduce, duplicate, copy, or resell any portion of the Site or its content without our prior written consent.

3. Service Requests and Quotes

When you submit a service request or request a quote through the Site, by phone, or by email, you authorize BakerHouse to contact you at the phone number and email address you provide. Quotes are estimates only and are not binding until reduced to a signed service agreement or work order. Final pricing may change based on conditions discovered on-site, parts availability, code requirements, and the scope of work you authorize.

4. Scheduling, Arrival Windows, and Cancellations

We do our best to honor scheduled appointment times and provide arrival windows in advance. Emergency calls, weather, traffic, and parts-supply delays may cause us to reschedule. If we expect to be more than 30 minutes late, we will contact you. If you need to cancel or reschedule, please contact us at least 24 hours in advance when possible.

5. Payment Terms

Payment is due upon completion of the work unless a different schedule is specified in your signed service agreement. We accept cash, check, and major credit cards. Past-due balances may be assessed a service charge of 1.5% per month (18% APR) or the maximum permitted by New Mexico law, whichever is lower. If we incur collection costs, including reasonable attorneys' fees, you agree to reimburse those costs.

6. Workmanship Warranty

BakerHouse warrants its labor against defects in workmanship for a period of 30 days from the date of service unless a longer warranty is specified in writing on your service agreement. Equipment we install is covered by the manufacturer's warranty for the period and on the terms set by the manufacturer; we will assist you in coordinating manufacturer warranty claims.

This warranty does not cover:

  • Damage caused by misuse, abuse, neglect, or unauthorized modification of equipment;
  • Damage caused by power surges, lightning, flood, fire, freezing, vermin, or other casualty;
  • Routine wear-and-tear items (filters, belts, refrigerant top-offs, etc.);
  • Repairs performed by anyone other than BakerHouse after our service date;
  • Pre-existing conditions in equipment or building systems that we did not install.

7. Limitation of Liability

To the maximum extent permitted by law, BakerHouse's total liability arising out of any service, product, or use of the Site is limited to the amount you paid for the specific service or product giving rise to the claim. BakerHouse is not liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost business, food spoilage, or property damage exceeding the cost of the service performed, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be lawfully limited under New Mexico law, including liability for gross negligence, willful misconduct, or fraud.

8. Indemnification

You agree to indemnify and hold BakerHouse, our employees, and our subcontractors harmless from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any law, or your misuse of our services.

9. Intellectual Property

All content on the Site — including text, photos, project documentation, logos, and design — is owned by BakerHouse or our licensors and is protected by U.S. copyright and trademark law. You may not reproduce or republish Site content without our prior written consent, except for personal, non-commercial use.

10. Third-Party Tools and Widgets

The Site embeds third-party tools and widgets, including Real Work Labs (recent-projects and project-map widgets), Google (Maps, Fonts, Ads), and Meta (Facebook Pixel). Your use of those tools is also governed by the respective third party's terms. We do not control and are not responsible for third-party content or services.

11. Reviews and Project Photos

When we complete work, our techs may capture geo-tagged photos and notes as part of our standard documentation. By engaging us, you grant BakerHouse a non-exclusive, royalty-free license to use those photos and notes — with any personally identifying information removed — in our portfolio, on the Site, in our marketing, and on third-party platforms (such as Real Work Labs) that power our "Recent Projects" and review widgets. If you do not want a particular job featured, tell your tech on-site or email bakerhouseserviceco@proton.me within 7 days of service.

12. Communications

By providing your phone number or email address, you consent to receive transactional messages from us about your service request, appointment, invoice, or follow-up. We do not sell your contact information. You may opt out of marketing messages at any time by replying STOP to a text or clicking "unsubscribe" in an email; transactional messages will continue while you have an open service request.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or our services will be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts. You and BakerHouse waive any right to a jury trial.

14. Changes to These Terms

We may update these Terms from time to time. The current version always lives at bakerhouse.com/terms-of-service with the effective date posted at the top. Material changes will be communicated more prominently (for example, by a banner on the Site or by email to active customers).
